By accessing or using ClairDocs Logistics services, platform, or related software, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must immediately cease use of our services. Your continued use signifies acknowledgment and acceptance of these terms and applicable industry standards.
2. Description of Service
ClairDocs provides a cloud-based software solution designed to streamline the workflow, management, and automation of international trade documentation. This includes but is not limited to bills of lading, commercial invoices, shipping labels, and all aspects of freight. However, the right to modify, suspend, or discontinue any aspect of the service at any time without prior notice.
3. User Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during the registration process. Furthermore, your use of the service must comply with all applicable laws and regulations and should not interfere with the rights or operations of other users.
4. Intellectual Property Rights
The ClairDocs platform, including all proprietary algorithms, user interfaces, designs, trademarks, and content, is protected under applicable intellectual property laws and regulations. Users are granted a limited, non-exclusive license to use the service for permitted business purposes only. Redistribution, modification, or derivative use of platform-related assets without explicit written consent is strictly prohibited.
5. Data Privacy and Security
Your use of the service is also governed by our Privacy Policy. We employ industry-standard security measures to protect your data, but no method of transmission over the Internet or electronic storage is 100% secure. We acknowledge that your privacy and information are important to your trust. ClairDocs cannot guarantee absolute security but continuously works to improve safeguards.
6. Limitation of Liability
To the maximum extent permitted by law, ClairDocs shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, data, or goodwill, resulting from your use or inability to use the service. Our total liability for any claims arising out of these terms shall not exceed the amount paid by you to ClairDocs in the twelve months preceding the claim.
7. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction in which ClairDocs Logistics is headquartered, without regard to its conflict of law principles. Any legal action or proceeding arising under these terms will be brought exclusively in the courts located in such jurisdiction.
8. Termination
We may terminate or suspend your access to the service immediately, without prior notice or liability, for any reason whatsoever, including violation of these Terms of Service. Upon termination, your right to use the service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive termination.
